You must notify us immediately at support@dgmartestore.com if you suspect any unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. BUYER TERMS

Placing Orders
By placing an order, you confirm that all information provided — including your delivery address and payment details — is accurate and complete. Orders are confirmed only upon receipt of payment, or acceptance of Cash on Delivery (COD) where applicable. An order confirmation email will be sent to your registered email address upon successful placement.
DG Marte Store and its sellers reserve the right to cancel any order in cases of pricing errors, stock unavailability, or suspected fraudulent activity.

Product Listings & Accuracy
Product descriptions, images, and specifications are provided by individual sellers and are subject to change without notice. We make reasonable efforts to ensure listing accuracy but do not guarantee that all information is error-free. Colours of products may slightly vary from images due to display settings. Please read product descriptions carefully before placing an order.

Cancellations by Buyer
Orders may be cancelled before dispatch, subject to the seller's cancellation policy. Once an order has been dispatched, it cannot be cancelled — a return or refund request must be raised instead.

4. SELLER TERMS

Seller Registration & Verification
Sellers must provide accurate business information, valid identity proof, and complete the full verification process before their store goes live. Sellers must hold all licences, permits, and registrations required to legally sell their listed products. False or misleading registration information will result in immediate account suspension.

Seller Responsibilities
• Sellers are solely responsible for the accuracy, quality, legality, and authenticity of their listed products
• Sellers must fulfil orders within the stated processing and dispatch timeframe
• Sellers must handle returns, refunds, and customer complaints in accordance with DG Marte Store's policies
• Sellers may not list counterfeit, prohibited, restricted, or harmful products on the platform
• Sellers are responsible for all applicable taxes, including GST, on their sales

Seller Fees & Commissions
DG Marte Store charges a platform commission on each completed sale, as communicated during seller onboarding. Commission rates and fee structures may be updated with advance notice. Payments to sellers are processed after deduction of applicable commissions and fees.

Important: DG Marte Store acts as a marketplace facilitator only. We are not a party to the transaction between buyer and seller. Each seller is an independent entity responsible for their own products and obligations.

5. PAYMENTS & PRICING

• All prices displayed on the platform are in Indian Rupees (INR) and include applicable taxes unless stated otherwise
• We accept UPI, credit/debit cards, net banking, digital wallets, and Cash on Delivery (COD) where available
• Payments are processed through secure, third-party payment gateways. We do not store your card or banking credentials
• In case of a failed transaction where the amount has been debited, it will be refunded to the original payment source within 5–7 business days
• DG Marte Store reserves the right to modify prices, offers, and discounts at any time without prior notice
• Promotional pricing and coupon codes are subject to their individual terms and validity periods

6. SHIPPING & DELIVERY

• Delivery timelines are estimates and may vary based on product type, seller location, buyer location, and logistics partner availability
• Estimated delivery dates are communicated at checkout and in the order confirmation email
• DG Marte Store is not responsible for delays caused by the logistics partner, natural events, public holidays, or an incorrect delivery address provided by the buyer
• Risk of loss and title for products passes to the buyer upon delivery to the shipping address
• If a delivery attempt is unsuccessful due to the buyer's unavailability, re-delivery may be attempted or the order may be returned to the seller
• Shipping charges, if applicable, are clearly displayed at checkout before order confirmation

7. RETURNS & REFUNDS

Return Eligibility
Returns are accepted only if the product is defective, damaged during transit, incorrect (wrong item sent), or significantly different from the listing description. Return requests must be raised within 48 hours days of delivery through your order dashboard. Products must be unused, in original packaging, and accompanied by all original accessories and tags.

Refund Process
Approved refunds will be processed to the original payment method within 5–7 business days of return pick-up and verification. COD orders will receive refunds via bank transfer. Shipping charges are non-refundable unless the return is due to a seller error or a defective product. DG Marte Store reserves the right to reject return requests that do not meet the eligibility criteria stated above.

8. PROHIBITED ACTIVITIES

The following activities are strictly prohibited on DG Marte Store and may result in immediate account suspension, permanent banning, and/or legal action:
• Listing, selling, or purchasing counterfeit, pirated, or stolen goods
• Listing products that are illegal under Indian law, including narcotics, weapons, or hazardous materials
• Using the platform for any fraudulent, deceptive, or misleading activities
• Attempting to manipulate product reviews, ratings, or search rankings
• Sharing or using another person's account credentials
• Interfering with or disrupting the technical operation of the platform
• Collecting or harvesting personal data of other users without their consent
• Circumventing platform fees by conducting transactions outside the platform
• Uploading malicious code, viruses, or any software intended to harm the platform or its users
• Using the platform for purposes unrelated to legitimate buying, selling, or commercial activity

9. INTELLECTUAL PROPERTY

All content on DG Marte Store — including logos, graphics, interface design, text, and software — is the intellectual property of DG Marte Store or its licensors. You may not copy, reproduce, distribute, modify, or commercially exploit any part of our platform without prior written permission.
Sellers retain ownership of their product images and descriptions but grant DG Marte Store a non-exclusive licence to display this content on the platform for the purpose of selling their products. Any feedback, suggestions, or ideas you submit to us may be used by DG Marte Store without obligation or compensation.

10. LIMITATION OF LIABILITY

• DG Marte Store acts as a marketplace and is not responsible for the quality, safety, legality, or fitness of products sold by third-party sellers
• We do not guarantee uninterrupted, error-free access to the platform at all times
• DG Marte Store's total liability to any user — for any reason — shall not exceed the total value of the order in dispute
• We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform
• We are not responsible for losses caused by force majeure events including natural disasters, government actions, strikes, or network outages
The platform is provided on an "as is" and "as available" basis. DG Marte Store makes no warranties, express or implied, regarding the platform's merchantability or fitness for any particular purpose.

11. DISPUTE RESOLUTION

In the event of a dispute between a buyer and a seller, DG Marte Store will attempt to facilitate a fair resolution based on available evidence and platform records. Users must first attempt to resolve disputes through our customer support channel before escalating further.
DG Marte Store's decision in platform-level disputes will be considered final and binding. Any legal disputes that cannot be resolved amicably shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996.

12. GOVERNING LAW & JURISDICTION

These Terms & Conditions are governed by and construed in accordance with the laws of India, including:
• The Information Technology Act, 2000 and its amendments
• The Consumer Protection Act, 2019
• The Indian Contract Act, 1872
• The Sale of Goods Act, 1930
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Haryana, India.

13. CHANGES TO THESE TERMS

DG Marte Store reserves the right to update or modify these Terms & Conditions at any time. When changes are made, the "Last Updated" date at the top of this page will be revised. Significant changes will be communicated via email or a platform notification. Your continued use of the platform after any changes constitutes your acceptance of the updated terms.
